These Terms of Service (“Terms”) govern your use of DeepStretches.com, shop.deepstretches.com, DS Club membership features, and Deep AF AI tools (collectively, the “Services”). By using the Services, you agree to these Terms.

Deep Stretches is operated by Dark Horses USA.

1) Eligibility

You must be at least 13 years old to use the Services. If you are under the age of majority where you live, you may use the Services only with permission of a parent or legal guardian.

2) Accounts and security

You are responsible for:

Maintaining the confidentiality of your login credentials
All activity that occurs under your account
Keeping your account information accurate and current

We may suspend or terminate accounts for policy violations, fraud, abuse, or security risk.

3) Store purchases, memberships, and billing

A) Orders and digital access

Product availability, pricing, and descriptions can change. We may refuse, cancel, or limit orders if we believe the transaction is fraudulent, abusive, or technically erroneous.

B) Payments

Payments are processed through the checkout payment method you select. Deep Stretches does not intentionally store full payment card numbers on its own servers.

C) Subscriptions and memberships (DS Club)

If you purchase a subscription or membership:

Billing is recurring at the interval shown at checkout (monthly, annual, or otherwise).
Unless stated otherwise at checkout, subscriptions renew automatically until canceled.
You can cancel through your account settings (if available) or by contacting support before the next renewal date.
If you cancel, access typically continues until the end of the current paid period unless otherwise stated at checkout.

D) Refunds and chargebacks

Default policy: All sales are final unless required by law, unless a specific product page or checkout screen states a different policy.

If you initiate a chargeback without first contacting support to resolve the issue, we may suspend access to the Services during the dispute investigation and may restrict future purchases to prevent fraud.

4) Acceptable use

You agree not to:

Violate any law or regulation
Infringe others’ rights (privacy, publicity, copyright, trademark)
Upload malware, attempt to hack, probe, or disrupt the Services
Abuse the Services (spam, automated scraping, denial of service, bypassing security)
Harass, threaten, impersonate, or dox any person

We may remove content, restrict features, or terminate access for violations.

5) User content

You retain ownership of content you submit. You grant Deep Stretches a limited, worldwide, royalty free license to host, store, reproduce, transmit, and display your content only as needed to operate the Services.

You are responsible for your content, including ensuring you have the rights to submit it.

6) Intellectual property

The Services (including branding, design, text, graphics, code, and original content) are owned by Deep Stretches and/or its licensors, excluding user content.

You may not copy, distribute, modify, or create derivative works from the Services except where permitted by law or with written permission.

7) Deep AF AI Usage Policy (required)

Deep AF is an AI powered feature. It is provided for assistive use, not guaranteed truth.

A) What Deep AF is for

Deep AF can be used for brainstorming, drafting, summarizing, planning, creative writing, and general support.

B) Prohibited uses

You may not use Deep AF to:

Facilitate wrongdoing, fraud, theft, or evasion of law enforcement or security controls
Generate or promote violence, harassment, or hateful content targeting protected groups
Generate sexual content involving minors or exploitative sexual content
Attempt to bypass safeguards, extract hidden system instructions, or jailbreak the feature
Upload or request content that infringes intellectual property rights
Submit extremely sensitive data (payment card numbers, government IDs, medical records, passwords, private keys)

We may restrict or terminate Deep AF access for violations.

C) Accuracy and reliance disclaimers

AI output may be inaccurate or misleading. You are responsible for verifying outputs before relying on them. Deep AF does not provide professional advice (medical, legal, financial, safety critical, or otherwise).

D) Ownership of AI inputs and outputs

You own your inputs. Outputs may not be unique, and similar results could be generated for other users. You are responsible for how you use outputs and for ensuring your use does not violate laws or rights.

E) Moderation and enforcement

We may use automated detection and limited human review when necessary to prevent abuse, enforce policies, or protect users and the platform.

8) Third party services

The Services may integrate with third party tools (payments, analytics, shipping, embedded media, AI providers). Your use of third party services may be governed by their own terms. Deep Stretches is not responsible for third party services.

9) Disclaimers

The Services are provided “as is” and “as available.” To the fullest extent permitted by law, Deep Stretches disclaims warranties of merchantability, fitness for a particular purpose, and non infringement.

We do not guarantee uninterrupted, error free, or completely secure operation.

10) Limitation of liability

To the fullest extent permitted by law, Deep Stretches will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues.

To the fullest extent permitted by law, total liability for any claim related to the Services will not exceed the greater of:

the amount you paid to Deep Stretches in the 12 months before the event giving rise to the claim, or
USD $100.

Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.

11) Indemnification

You agree to indemnify and hold harmless Deep Stretches (including Dark Horses USA) from claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your content, or your violation of these Terms.

12) Termination

You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms, create risk, or misuse the Services.

Sections that should survive termination (intellectual property, disclaimers, limitation of liability, indemnification) will survive.

13) Changes to these Terms

We may update these Terms. We will update the “Last updated” date when changes are posted. Continued use after changes means you accept the updated Terms.

14) Governing law and venue

These Terms are governed by the laws of the United States and the state where Dark Horses USA is headquartered, without regard to conflict of law rules. Any dispute must be brought in the state or federal courts located in that state, unless applicable law requires otherwise.
